Terms of Service
The terms that govern your use of the Electra Visibility Lab website and our digital marketing services.
1. Agreement and scope
These Terms of Service (“Terms”) govern access to and use of the Electra Visibility Lab website and any digital marketing, performance creative, paid media, generative engine optimization (GEO), or related strategic services we provide. “Electra,” “we,” “us,” or “our” means Electra Visibility Lab. By using this website or engaging us for services, you agree to these Terms.
2. Our services
Our services are described on this website and in the applicable proposal, statement of work, or other written agreement between you and Electra. A project’s specific scope, timing, deliverables, fees, payment terms, and responsibilities will be controlled by that written agreement. If these Terms conflict with a signed agreement, the signed agreement controls for that engagement.
Marketing outcomes depend on many factors, including your market, offer, budget, channel policies, creative assets, data quality, and decisions made by third parties. We do not promise a particular level of traffic, revenue, conversion rate, search ranking, AI recommendation, or return on ad spend.
3. Use of this website
You may use this website only for lawful purposes and in accordance with these Terms. You agree not to interfere with the website, attempt unauthorized access, introduce malicious code, scrape or reproduce material at scale, impersonate another person, or use our content to mislead others. We may suspend access to the website when reasonably necessary to protect our service, users, or business.
4. Intellectual property
The website and its contents—including text, visual identity, graphics, layouts, frameworks, and original materials—belong to Electra or our licensors and are protected by applicable intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to access the website for its intended purpose. You may not copy, modify, publish, distribute, sell, or create derivative works from our materials without our written permission.
Ownership and permitted use of client materials and project deliverables will be set out in the applicable written agreement. You retain responsibility for having the rights and permissions needed for materials you provide to us.
5. Third-party platforms and links
Our work may involve third-party platforms, advertising networks, analytics tools, scheduling services, or other websites. Those services have their own terms, privacy practices, availability, and policies. We are not responsible for a third party’s acts, omissions, content, security, or changes to its platform or policies.
6. Disclaimers
The website and its content are provided on an “as available” basis for general information. To the fullest extent permitted by law, Electra disclaims warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, availability, and uninterrupted or error-free operation. Website content is not legal, financial, tax, or other professional advice.
7. Limitation of liability
To the fullest extent permitted by law, Electra and its owners, employees, contractors, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from or related to the website or services. Our aggregate liability for a claim relating to the website or services will not exceed the fees you paid to Electra for the specific services giving rise to the claim during the six months before the event.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you. Nothing in these Terms limits liability that cannot legally be limited.
8. Governing law
These Terms are governed by the laws of the jurisdiction where Electra Visibility Lab is established, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be brought in the courts with appropriate jurisdiction in that location, unless applicable law requires otherwise.
9. Changes and contact
We may update these Terms from time to time by posting a revised version on this page. The updated effective date will indicate when changes take effect. Questions about these Terms can be sent to electravisibilitylab@gmail.com.
